(DB) No. 732 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Chittaranjan Police Station Case No. 22 of 2020 dated 17.07.2020 under Sections 302/34/120B/201 of the Indian Penal Code read with Sections 25/27 of the Arms Act.

And In Re : Rahul Kumar Singh ..... petitioner Mr. Jaydeep Biswas ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Jonaki Saha ... for the State Learned Counsel for the petitioner submits he is in custody for 952 days. It is also submitted that there is no evidence connecting him with the murder. He renews his prayer for bail.

Learned Counsel for the State opposes the prayer for bail and submits trial is in progress.

We have considered the materials on record. Bail prayer of the petitioner was rejected earlier on merits. Trial has substantially progressed. Under such circumstances, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
