This writ petition is directed against a notice under section 13(4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI).

It is submitted on behalf of the respondent bank that the petitioner has a statutory alternative efficacious remedy and the instant proceeding is not maintainable.

On behalf of the petitioners it is submitted that they are ready and willing to settle the disputes by making a payment of Rs.17 lacs. This is not acceptable to the private respondent bank.

In such circumstances, WPA 4318 of 2026 stands dismissed on the ground of maintainability.

Liberty is granted to the petitioner to avail of statutory alternative remedy under section 17 of the Act if the circumstances so warrant.
