IN THE HIGH COURT AT CALCUTTA

Item No.23 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 515 of 2012 (Via Video Conference) Sri Bikash Bhattacharjee versus Smt. Mugdaha Bhattacharjee & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

The present revisional application has been preferred against the judgment and order dated 20.01.2012 passed by the learned Sessions Judge, Jalpaiguri in connection with Criminal Revision No. 24 of 2011. The order reflects that the learned sessions court while exercising its revisional jurisdiction was pleased to modify the order passed by the learned C.J.M., Jalpaiguri in Misc. Case No. 21/2006 and directed the petitioner to pay Rs.2,000/- per month to the wife and Rs.2,000/- per month to the minor child by way of interim maintenance.

Having regard to the fact that the quantum so fixed by the learned sessions court is by way of an interim measure during the pendency of the revisional application, I am of the view that no interference is called for.

Accordingly, CRR 515 of 2012 is dismissed.

Interim order, if any, is hereby vacated.

All pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
