It appears that despite issuance of several administrative notices to the parties and endeavours made by this court, none of the parties has been brought on record.

What I feel, the parties have lost their interest to proceed the instant appeal.

This appeal was preferred by the Union of India being aggrieved by the judgment of acquittal passed by the learned Chief Judicial Magistrate, Uttar Dinajpur at Raigunj in C.R.Case No. 179 of 1993 (T.R. No.26 A/1994 under Section 3 (A) of the R.P.(U.P.) Act, 1966. After reading the judgment minutely I find that the learned Trial Judge passed the judgment on proper assessment and appreciation of the evidence on record. However, I have gone through the evidence on record. I find no illegality or infirmity in the judgment. As such the judgment does not call for any interference by this court.

In view of the above, the appeal is dismissed.

The judgment passed by the learned Chief Judicial Magistrate, Uttar Dinajpur, Raigunj in C.R.Case No. 179 of 1993 (T.R. 26A/1994 under Section 3(A) of the R.P.(U.P.)Act, 1966 is hereby confirmed.

Let a copy of this order along with the Lower Court records be sent down to the learned Court below. The appeal is disposed of accordingly.

Xerox certified copy of this order, if applied for, be given to the parties on urgent basis.
