(Via Video Conference) Mr. Mani Sankar Chattopadhyay ...for the respondents It is seen from the records that the petitioner has defaulted in appearing to move the matter on several occasions. In fact, the writ petition had previously been dismissed for default once and subsequently restored.
It is evident from the writ petition itself and the prayers made therein, as well as the submission of learned counsel for the Distribution Company, that the dispute raised herein pertains to a billing dispute which is, under the existing Regulations, judicable before a Grievance Redressal Officer (GRO).
Hence, there is no use in keeping the matter pending unnecessarily.
WPA No. 3198 of 2018 along with CAN 1 of 2019 and CAN 2 of 2019 are disposed of with liberty to the petitioner to approach the concerned GRO for a decision on the dispute raised in the present writ petition.
It is made clear that, in view of the pendency of the writ petition in the interregnum, the limitation period for the purpose of moving the GRO shall be deemed to commence from this date. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
