C.R.M. (NDPS) 265 of 2022 (AD) 09.03.2022 Court No.29 (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with English Bazar P.S. Case No.667 of 2020 dated 10/08/2020 under Sections 21(C)/29 of the NDPS Act (NDPS Case No.63/2021).

Petitioner renews the prayer for bail.

Considering the fact that there is hardly any material change in circumstances subsequent to the earlier order of rejection dated August 10, 2021 in CRM 3665 of 2021 and considering the fact that commercial quantity of narcotics was seized from the possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected. C.R.M. (NDPS) 265 of 2022 is dismissed.
