In Re: An application under Section 439 of the Code of Criminal Procedure/under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed on 20th February, 2025 in connection with Kaliachak Police Station Case no. 215/2018 dated 03.04.2028 under Sections 341/326/307/120B/34 of the Indian Penal Code and Sections 25/27 of the Arms Act.

Mr. Madhusudan Sur ... For the State Bail prayer of the petitioner was turned down on earlier occasions, considering the merits of the case. The petitioner seeks bail solely on the ground of his prolonged detention. He is in custody for more than 6 years. Learned counsel for the State submits that examination of prosecution witnesses is complete and the case is waiting for examination of the petitioner under Section 313 of the Code of Criminal Procedure. Since the trial of the case is at its fag end and there is no change of circumstance after the earlier prayers of the petitioner were turned down, prayer for bail is rejected at this stage.

Learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.

The application for bail is disposed of.
