Heard learned counsels for the parties.

Pursuant to the order passed on 22nd February, 2023 the stay application filed by the petitioner in the appeal pending before the District Magistrate North 24 Parganas was taken up for consideration.

It appears from the copy of the order passed on 28th February, 2023 that the stay application was refused but the WBEIDCL was directed not to encumber/create any third party rights and/or interests upon scheduled land during pendency of hearing of the appeal.

Learned counsel for the petitioner prays for keeping the writ petition pending till disposal of the appeal.

The decision taken in the appeal shall give rise to a fresh cause of action, if any.

In view of the order passed by the District Magistrate, North 24 Parganas on 28th February, 2023, nothing further remains to be adjudicated in the present writ petition. Accordingly, the writ petition being WPA 4282 of 2023 is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
