The petitioner is aggrieved because her application under Section 23 of the Protection of Women from Domestic Violence Act, 2005 has not been heard by the learned Judicial Magistrate, 2nd Court, Alipore expeditiously. It is also submitted by the learned advocate for the petitioner that the petitioner has no source of income and without

monetary allowance the petitioner finds acute hardship to maintain herself along with her two school going children. This Court is of the view that the instant revision can be disposed of here and now.

I have perused the instant revision and other materials on record. An application for interim monetary allowance is required to be disposed of in a time bound manner. The learned Magistrate must be alive to the fact that the provisions in PWDV Act are enacted to ameliorate the plight of the aggrieved persons who are facing domestic violence.

Considering such aspect of the matter, the learned Judicial Magistrate, 2nd Court at Alipore is directed to dispose of the application under Section 23 of the PWDV Act within two months from the date of communication of this order positively. The application is, thus, disposed of.
