The petitioner contends that on the petitioner having applied for a commercial connection of electricity, the CESC Limited has refused to give such connection on the ground that there is apprehended splitting of load, which will give rise to a contravention of Regulation 14 of the WBERC (Recovery of expenditure for Providing New Connections) Regulations, 2013.

The governing Regulations also provide that such disputes shall be decided by the concerned Grievance Redressal Officer (GRO).

Hence, WPA 4284 of 2023 is disposed of upon hearing learned counsel for the parties with liberty to the petitioner to approach the appropriate Grievance Redressal Officer for resolving the dispute as raised in the present writ petition.

If so approached, the concerned GRO shall decide the issue in accordance with law, upon giving opportunity of hearing to all concerned, without being influenced in

any manner by any of the observations made herein, as expeditiously as possible, preferably within six weeks from the date of making such reference.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
