Case No.343 of 2021 dated 02/09/2021 under Sections 379/188 of the Indian Penal Code, 1860 and Sections 4/21 of Mines and Mineral Act, Section 15 of the Environment Protection Act. (G.R. 2535/2021).
And (Rejected) In the matter of: - Tarakeshwar Roy ...petitioner.
Mr. Shiv Chandra Prasad Mr. Nikhil Kumar Gupta ... for the petitioner.
Mr. Tapandeb Nandy Mr. Antarikhya Basu ...for the State.
Petitioner seeks anticipatory bail.
Learned Advocate appearing for the petitioner submits that the petitioner was falsely implicated.
Learned Advocate appearing fore the State draws the attention of the Court to the materials in the case diary. He submits that there are sufficient materials in the case diary to suggest that the petitioner is one of the main persons involved in the illegal sand mining.
Considering the gravity of the offence and the involvement of the petitioner therein, the necessity of custodial interrogation of the petitioner cannot be discounted. In such circumstances, we are unable to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the
petitioner is rejected.
C.R.M. (A) 1149 of 2022 is dismissed.
