(Through Video Conference) Mr. Kaushik Gupta, Mr. Debayan Sen ....for the petitioner Mr. Subhabrata Datta, Mr. Debasish Sarkar ....for the State-respondents Counsel for the petitioner submits that the Investigating Officer of the Anti Human Trafficking Unit, CID, West Bengal has not been able to either file final report before the Magistrate or nab the culprits in relation to Basanti Police Station Case No. 95 dated 25/02/2016 under Sections 363/366A/372/34 of the Indian Penal Code.

It is submitted by Mr. Datta that the minor girl who was trafficked and has been recovered, is the daughter of the writ petitioner. This Court is of the view that the Anti Human Trafficking Unit, CID, West Bengal should have a fair idea now of the whereabouts

of the culprits, since raids have been conducted about six times on various locations.

It is expected that the investigating agency take steps for enforcing the attendance of the accused persons and/or apprehended them by this time in terms of the provisions of the Cr. P.C.

in the nature of proclamation and attachment.

Insofar as the prayer of the petitioner that the investigation should be handed over to the CID, West Bengal, Mr. Datta, learned counsel for the State-respondents submits that the Anti Human Trafficking Unit comprises of the Officers of the CID, West Bengal and also other senior and experienced police personnel.

In that view of the matter, it is ordered that the final report in the matter be filed before the concerned Magistrate within a period of 45 days from the date of communication of a copy of this order.

The petitioner shall be at liberty to take exception to such report in accordance with law if so advised.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.
