Mr. Majumder, learned counsel for the petitioner, has placed his exception to the report of the Director General and Inspector General of Police, West Bengal. It is submitted that in the context of a charge attempt to mislead this Court, the proposed disciplinary proceedings against ASI Anirban Biswas is inadequate. Mr. Majumder, learned counsel for the petitioner, would place reliance upon page 30 of the writ petition, being a report of the ASI Sudip Biswas addressed to the learned Additional Chief Judicial Magistrate, Baruipur dated 7th February, 2022.

It is submitted that the first paragraph of the letter would clearly indicate that the accused namely Binodh Yadav was, in fact, being shielded by one Minakshi Modi in whose car he was found.

The Director General and Inspector General of Police, West Bengal is expected to ensure that major penalty proceedings are drawn up against the said Anirban Biswas.

This Court is short of issuing rule of contempt since the Director General and Inspector General of Police, West Bengal has already chosen to initiate departmental proceedings.

The Director General and Inspector General of Police, West Bengal shall file a report before the Registrar General of this Court as regards the nature of disciplinary proceedings initiated against the said Anirban Biswas.

Mr.

Sabyasachi Banerjee, learned counsel, representing accused Binodh Yadav and other persons, who initially expressed a desire that his client be added as a party respondent to the instant proceedings, has subsequently withdrawn his prayer.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
