Petitioners have restricted their prayer at this stage in respect of the warrant of arrest which has been issued in connection with Shakespeare Sarani P. S. Case No. 175 of 2022 and the chargesheet submitted therein under Sections 385/120B IPC before the learned Metropolitan Magistrate, 4th court, Calcutta. Having regard to the nature of the offence complained of and the fact that at the first instance, the learned Magistrate issued warrant of arrest without describing the nature of the warrant of arrest so issued, I direct that the warrant of arrest so issued on 20th December, 2023 be treated as a bailable warrant. Petitioners would be at liberty to appear before the learned Metropolitan Magistrate, 4th court, Calcutta either physically or through a learned advocate of their choice with usual undertakings.

This order will remain in force till 31st March, 2024. Petitioners would take appropriate steps before the learned Metropolitan Magistrate, 4th court, Calcutta.

If within the aforesaid scheduled time the petitioners do not take any steps, the learned Magistrate would be at liberty to issue non-bailable warrant of arrest and consequent harsher process of law.

With the above observations, the present revisional application being CRR 712 of 2024 is disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
