The petitioner complains of inaction on the part of the Harishchandrapur Police Station. The petitioner has lodged a complaint against his son and daughter-inlaw for torturing him and as a consequence thereof he had to leave the house.

The son and daughter-in-law are represented. It is submitted that since after the death of the mother, the petitioner has been beneficiary of Rs.22 lacks of insurance. He was implicated for the murder of his mother, but was acquitted subsequently.

The private respondent/son submits that while it is true that the house belongs to the petitioner, there has been a design engineered by the petitioner's new wife to oust the children from the house.

This Court does not wish to enter into the rights of the parties in respect of the property in question. The son has no objection to the petitioner returning and living in his own house.

Learned senior counsel for the petitioner, Mr. Moitra, has submitted before this Court that his client does not wish to evict the children from the house and wish to live with them cordially.

In that view of the matter, the petitioner and his wife may return to their house. The parties shall try to live in peace.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
