For the State The petitioner is, inter alia, seeking implementation of various memoranda issued by the Finance Department, Audit Branch, from time to time. The dates of the memoranda as provided in the writ petition are respectively 16th September, 2011, 25th February, 2016 and 15th July, 2019.

After hearing the parties and considering the materials on record, I find that justice will be sub-served if I direct the Principal Chief Conservator of Forest (Head of Forest Force), being the respondent no.2, to consider the representations made by the petitioner to the Divisional Forest Officer, Kangsabati North Division, appearing at page 73 of the writ petition and dated 26th November, 2021 appearing at page 74 of the writ petition, by a reasoned order after affording the petitioner an opportunity of hearing within a period of three months from date. The reasoned

order shall be communicated to the petitioner within fifteen days from the date of passing of the same.

The respondent no.2 shall be free to come to an independent finding as to the issues raised by the petitioner in the two representations without being anyway influenced by the observations made in this order.

The parties, including the respondent no.2, shall act on the basis of a server copy of this order without insisting upon production of a certified copy thereof. Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
