The revisional application was preferred before this Court challenging the continuance of the proceedings relating to Cyber Police Station Case No.119 dated 11.12.2020 pending before the learned Chief Metropolitan Magistrate, Calcutta. I have considered the contents of the present revisional application which was in the nature of a compromise or settlement arrived at between the parties.

The main thrust of subject-matter of investigation relates to forgery of digital signature and siphoning of money. Having considered the seriousness of the offence and that a public policy is involved the nature of the transaction which has taken place and which has been tried to be diluted by entering into a compromise, the same cannot be acceded to. Report submitted by the Assistant Commissioner of Police, Calcutta be kept with the record.

No interference is called for in this revisional application.

Accordingly, CRR 452 of 2021 is dismissed.

Pending application, if any, is consequently dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
