This revisional application has been filed for expeditious disposal of the preliminary issues framed by the learned court below, i.e., the learned Civil Judge (Senior Division), 3rd Court, Barasat, North 24Parganas in Title Suit No. 1321 of 2015. It is submitted that the said preliminary issues were framed pursuant to the order of this court. It appears that an application for injunction is also pending.

Without going into the merits of the case and without going into the rival contentions of the respective parties, this revisional application is disposed of with a direction upon the learned court

below to expeditiously dispose of the preliminary issues framed on the basis of the directions so given in C.O. 331 of 2017 and the application for injunction within two months from the next date fixed.

The revisional application is disposed of. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
