...for the opposite parties In view of the order passed in CO 371 of 2021 disposing of the Misc. Appeal, nothing remains to be decided in this revisional application. The report of the Advocate Commissioner which was taken on record while passing the order dated 20th December, 2020 was only in aid of passing of ad-interim order in the Misc. Appeal. Once the Misc. Appeal has been disposed of by this Court in CO No. 371 of 2021, nothing remains to be decided here.

The revisioinal application has become infructuous and accordingly disposed of.

It is made clear that the report of the Advocate Commissioner shall not used as an aid in any other proceeding in the suit. There will be, however, no order as to costs. This Court has not gone into the merits of the claim of the petitioners. The learned Court below shall proceed with the hearing of the injunction application in accordance with law. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis.
