The petitioner who is the defendant in Title Suit No.115 of 2020 has prayed for expeditious disposal of the application under Order XXXIX Rule 4 of the Code of Civil Procedure. Mrs. Agarwal, learned Advocate appearing on behalf of the opposite party, submits that the written objection to the said application has not yet been filed.

Time to file written objection to the application under Order XXXIX Rule 4 of the Code of Civil Procedure is extended by a period of three weeks. Let the application be heard expeditiously and be disposed of within a month from the date of disposal of the amendment application, as directed in C.O. No.374 of 2021.

It is made clear that this Court has not gone into the merits of the case and the learned Court below shall proceed in accordance with law and independently.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
