The petitioner is aggrieved by the fact that her application for transfer has been returned back to her by the head of the institution with the endorsement that the petitioner is the only teacher in the subject in the institution.

It appears that the action of the head of the institution is contrary to the circular of the State dated 3rd January 2022. Even in case where the applicant is the single teacher in the subject in the school the same is required to be forwarded to the District Inspector of School with the endorsement to that effect by the school management.

In view of the above, this Court directs the head of the institution to forward the petitioner's

application to the concerned District Inspector of School and the concerned District Inspector of School shall take suitable steps strictly in terms of the circular dated 3rd January 2022.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
