The petitioner participated in the recruitment process for Constable (GD) in CAPFs, NIA & SSA & Rifleman General Duty in Assam Rifle Examination 2021 conducted by Staff Selection Commission (SSC). The petitioner was a successful candidate and his name was included in the merit list published by SSC.

Mr. Bhattacharyya, learned counsel appearing on behalf of the petitioner submits that despite the name of the petitioner being recommended for appointment, no appointment has been given till date. The petitioner's queries under the Right to Information Act, 2005 have also not been answered.

It is also submitted that appointments in respect of most of the successful candidates have been given. Mr. Bajpayee, learned counsel appears on behalf of Union of India.

Considering the submissions of the parties and the materials placed on record, this Court directs the respondent no.4/the Directorate General, Central Reserve Police Force (Recruitment Branch) to take a final decision in respect of the petitioner and provide appointment to the petitioner if he is otherwise found eligible since his name has already been included in the merit list of successful candidates published by SSC. The entire exercise should be completed within a period of three months from date.

Since nothing further remains to be adjudicated in this writ petition, WPA 4322 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, all the allegations contained therein are deemed not to have been admitted by the parties.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
