Learned advocate appearing on behalf of the opposite party is present. He submits vide order dated 15.2.2017, this Court has suspended the sentence and fine and compensation imposed upon the petitioner for a period of eight weeks or until further order whichever is earlier on condition that the petitioner shall appear before the learned trial Court and deposit of sum of Rs.

30,000/- before the Court below within a period of fortnight from the date and shall appear before the trial Court within such period and shall be released on bail subject to satisfaction of the said Court. In the event the petitioner fails to appear before the learned trial Court and deposited such amount within the period as aforesaid

interim order of stay shall automatically stand vacated without further reference to this Court.

Heard. This Court is unable to find as to whether he has appeared or deposited sum as directed within the stipulated time or no? The petitioner did not appear on earlier occasions also.

Accordingly, the CRR 492 of 2017 is hereby dismissed for default.

Interim order, if any, stands vacated.
