It is submitted by learned counsel for the petitioner that the petitioner's daughter made a representation to the Superintendent, Baruipur Correctional Home for grant of parole to her father (petitioner before this court) on the ground that the petitioner's wife requires urgent medical treatment. The representation has not been responded to till date.

This matter had been called on yesterday when the petitioner was directed to serve respondent-authorities afresh by e-mail. A copy of the e-mail sent to the respondents intimating that the matter will be taken up today has been shown to the court. The respondent was served yesterday i.e. on 6th May, 2021 at about 12.56 p.m. Despite such service, the respondents are not represented.

Upon hearing learned counsel and perusing the writ petition, it appears that the writ petitioner is an under trial prisoner and has been in custody since 24th September, 2018. It has also been stated that the petitioner's wife is bed-ridden and requires urgent medical treatment.

In the facts as above, this court deems it feet to allow the writ petition by directing the respondent nos.2 and 3 to consider the representation made by the petitioner's daughter on 3rd February, 2021. The respondents will take a decision on the representation within a week from communication of this order and communicate such decision to the petitioner/ petitioner's daughter within three days on which the decision has been taken.

W.P.A. 4948 of 2021 is disposed of in terms of the above.
