The petitioner is in custody for about a year and prays for bail.

Learned counsel for the petitioner submits that the case is based on circumstantial evidence and the petitioner has not been directly implicated in the alleged offence by any of the witnesses examined during investigation. Charge sheet has been submitted. His further detention is not required.

Opposing the prayer, learned counsel for the State submits that prayer for bail of the co accused standing on the similar footing with the petitioner has been turned down by this Court.

The petitioner is part of the inter-State gang involved in the robbery, dacoity and murder. He has several criminal

antecedents of similar nature and may abscond or hamper the trial if enlarged on bail at this stage.

I have considered the material on record. The petitioner appears to be a member of an inter-State gang involved in the alleged offence. Several criminal antecedents of similar nature have been found against the petitioner. Co accused similarly circumstanced with the petitioner and member of the same gang was denied bail earlier. Blood stained shirt has been recovered at the behest of the petitioner and has been sent for forensic examination. The report is awaited.

Considering the nature and gravity of the offence as well as prima facie involvement of the petitioner therein, the prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
