Insurance Company and Mr. Joydeb Kumar Das, learned counsel for the respondent no.4 are present physically in Court who have no issue in the matter of withdrawal of the writ application.

Having heard learned counsel for all the parties, let the writ petition being, W.P.A. 3329 of 2011 be dismissed as withdrawn without any leave to sue afresh on the self-same cause of action.
