We have called for the status report of the suit. Let the same be kept with the record. It appears that the suit was dismissed for default on 16th January, 2018 and there is nothing on record to show that the suit was restored.

In view of the above, the appeal has now become infructuous. Accordingly, the appeal and the application for injunction stand dismissed.

The Registrar Administration (L & OM) is directed to communicate this order to the learned Judge, 13th Bench, City Civil Court, Calcutta.
