Petitioner approached this Court being aggrieved that the representation before the police authorities were not considered. However, during the pendency of the present writ petition, it has been submitted that a case has been already registered and necessary steps have been taken by the police authorities.
Petitioner presently prays that an impartial and fair investigation be conducted by the investigating authorities.
State has submitted a report which reflects that Chakdaha Police Station Case No.1097 of 2024 dated 04.10.2024 was registered for investigation. The investigation of the case is in progress. Notices under Section 94 of the BNSS have been issued.
I have considered that the police authorities have proceeded with the investigation.
The anxiety expressed by the petitioner is regarding fair and impartial investigation. The issue relating to fair and impartial investigation can be assessed at the end of an investigation and not in the midst of the investigation. However, police authorities are directed to put in efforts so that a logical conclusion can be arrived at within a reasonable period of time.
With the aforesaid observations, WPA 4437 of 2025 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
