Petitioner is aggrieved by the fact that the police authorities on the complaint of the petitioner registered a delayed FIR being New Town PS Case No. 42/25 dated 23.02.2025.

The said case was registered pursuant to the direction passed by the learned CJM under section 156(3) of Cr.P.C.

Investigation of the case has just commenced.

The purpose primarily reflects that the petitioner has set the criminal law into motion for removal of certain persons who are in possession of the property.

The right, title, interest and possession of a property is exclusive domain of the civil court.

The Investigating Officer will investigate the case but will not interfere with possession of any person.

With the aforesaid observations WPA 4333 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
