For the State Learned Advocate appearing for the petitioner submits that since the petitioner no. 1 surrendered before the jurisdictional Court, CRM (A) 1157 of 2022 be dismissed as not pressed on his behalf.

In the facts and circumstances, CRM (A) 1157 of 2022 is dismissed as not pressed so far as petitioner no. 1 is concerned.

So far as other petitioner nos. 2 to 6 are concerned, considering the gravity of the offence and the involvement of the petitioner nos. 2 to 6, we are inclined to grant anticipatory bail to petitioner nos. 2 to 6.

Accordingly, we direct that in the event of arrest, the petitioner nos. 2 to 6 Dulu Sk @ Dulu Sekh, Anai Bibi, Momena Bibi, Inamul Sk @ Enamul Sk, and Mijarul Sk shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on condition that the petitioner nos. 2, 5 and 6

will report before the Investigating Officer once in a month till the conclusion of the investigation and petitioner nos. 3 and 4 will cooperate with the investigation and on condition that petitioner nos. 2 to 6 shall appear before the Court below and prayer for regular bail within four weeks from date.

The prayer for anticipatory bail is allowed.

CRM (A) 1157 of 2022 is disposed of.
