The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The petitioner is the defendant of the Money Suit No. 239 of 2010, the said suit is pending before of the 4th Court of the learned Civil Judge (Senior Division) at Alipore, District : 24Parganas (South). The petitioner, on April 06, 2023, has filed an application under Order VII rule 11 of the Code of Civil Procedure and is complaining delay in disposal of the said application. The application for rejection of plaint by its nature demands expeditious disposal.

The learned Trial Judge is requested to dispose of the said application as expeditiously as possible in accordance with law, if it is otherwise ready for such disposal and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment.

C.O. 578 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
