Supplementary affidavit filed on behalf of the petitioners is taken on record.

The petitioners have preferred the present writ petition being aggrieved by the inaction on the part of the respondentHowrah Municipal Corporation in failing to effect mutation of the property situated at 31/1, Girish Ghosh Lane, P.S.

Malipanchghara, Howrah, in their favour.

It is the case of the petitioners that they have inherited the said property from their predecessor-in-interest. Pursuant thereto, the petitioners have submitted an application for mutation. However, despite regular follow-ups and due compliance of the requisite formalities, the respondent-HMC authorities have failed and/or neglected to take any step in furtherance of the petitioners' application.

Learned Advocate for respondent-HMC contends that the authorities are ready and willing to consider the representation of the petitioners.

Learned Advocate for the petitioners submits that his clients shall be satisfied if their representation considered and disposed of in a time bound manner.

Accordingly, this Court directs the Assessor, Howrah Municipal Corporation (respondent no.3) or any of his duly authorized delegates to consider and decide the representation of the petitioners by passing a reasoned order within a period of eight weeks from the date of communication of this order after affording an opportunity of personal hearing to the petitioners or any other stakeholder.

With the aforesaid directions, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Gaurang Kanth, J.)
