Petitioner is aggrieved by the continuance of the Criminal Appeal no. 21 of 2017 before the learned Additional District and Sessions Judge, FTC-4, Barrackpore. The subject matter of challenge in the said appeal related to the order dated 5th May, 2017 passed by the learned Judicial Magistrate, 4th court, Barrackpore in Misc. Case No. 219 of 2016.

It is peculiar that in this appeal even after six years the same has been kept pending as Public Prosecutor has not been appointed.

Having regard to the nature of the proceedings concerned and the limited issue on which the Public Prosecutor has to make his submissions, I am of the view that the appellate court would ensure the appearance of both the private parties on the next date so fixed and try to dispose of the appeal on the said date or within a month thereafter.

It is further directed that the learned appellate court would

be at liberty to fix as many numbers of dates, but would not stretch the timeline as has been fixed above.

With the aforesaid observations, the revisional application being CRR 717 of 2024 is disposed of.

Pending applications, if any, are consequently hereby disposed of.
