Learned advocate appearing for the petitioner submits that, intermittent quantity of narcotic was claimed to be seized from the house of the petitioner while the petitioner was not in the house.

Learned advocate appearing for the State submits that, commercial quantity of narcotic was seized from the house belonging to the petitioner.

Considering the fact that the police claim that commercial quantity of narcotic was seized from the house belonging to the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1161 of 2022 is dismissed.
