1. Learned counsel appearing for the petitioner submits as follows. The petitioner is the brother-in-law of the alleged victim. He stands on the same footing as some other coaccused were granted anticipatory bail by this Court on 04/08/2025 in CRM (A) 2428 of 2025. While out of the principal accused the husband was arrested and granted bail, the parents-in-law are still in custody.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the post-mortem report, the statements of witnesses and the dying declaration of the victim.

3. It appears from the dying declaration given by the deceased that she had not taken the name of the present petitioner who is the brother-in-law.

4. Considering the materials available in the case diary, the alleged role ascribed to the petitioner and the fact that

charge sheet has been submitted and the fact that the principal accused were arrested in this case, I am inclined to grant anticipatory bail to the petitioner.

5. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall not threaten or intimidate the witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
