The affidavit of compliance affirmed on behalf of the alleged contemnor on 06.3.2025 is taken on record. However, Mr. Souradeep Banerjee, learned counsel appearing on behalf of the petitioner submitted that statement upto March 2024 has been furnished.

Mrs. Ishita Kundu, learned counsel appearing on behalf of the alleged contemnors has submitted that yearly statement of account has been furnished and for the Financial Year 2024-2025 the assessment is not complete for which the statement of account could not be furnished.

However, the said submission appears to have been made in misleading of our order as we have directed alleged contemnor to furnish all accounts in respect of the partnership / proprietorship business month by month from

its inception to the respondent and it shall continue till the proceedings come to an end.

Accordingly, we extend the time to comply with our order by providing a consolidated statement from April 2024 till 31st May 2025 within a period of four weeks from date. 5.

All future directions with regard to furnishing the accounts shall abide by any direction that may be passed in the pending arbitration proceeding for which the parties are directed to approach the learned arbitrator. This direction is passed in view of the fact that the Arbitration Proceeding has already commenced and the learned Arbitral Tribunal is in seisin over the matter.

The application stands disposed of.

In the event the aforesaid is not complied with, the contempt proceeding shall revive.
