IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction CRR No.240 of 2015 Sri Goutam Sengupta -vsThe State of West Bengal & Anr.

None ...for the petitioner Mr. Arijit Ganguly Mr. Sanjib Kumar Dan ... for the State The revisional application has been preferred challenging the proceedings relating to Baguiati P.S. Case No.18 of 2009. The revisionist approached this court immediately after the charge-sheet was submitted before the jurisdictional court. As none appears for the State, Mr Sanjib Dan, who ordinarily appears for the State, is directed to represent the State. His appearance may be regularised by the concerned authorities. I have considered the contentions made in the revisional application and the prayer made therein for quashing the issues so raised in the application relating to question of facts which cannot be considered by this court at this stage. Further, the documents relied on by the prosecution under section 207 CrPC has not been enclosed along with the revisional application, thus, the stage is premature for interference by this court.

Accordingly, CRR No.240 of 2015 is dismissed. Pending applications, if any, are consequently disposed of. Interim order, if any, stands vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
