Report submitted by the learned advocate appearing for the State be also kept with the record. Report submitted by the Officer-in-Charge, New Barrackpore Police Station reflects that the Deputy Commissioner of Police, Detective Department, Barrackpore Police Commissionerate has already taken up the investigation of the case on 24.02.2025.

Petitioner's grievance is in respect of co-accused persons fleeing away and registration of FIR under the specific sections, which according to the petitioner, do not satisfy the physique of the deceased which was captured by way of a photograph at the time when the dead body was available.

Having considered that the investigation started on 11.02.2025 and already a superior officer of the police authorities is in helm of affairs for monitoring the investigation of the case, I am of the view that the investigation should be taken to

its logical conclusion by putting in efforts. If any accused persons are absconding and fleeing away from the process of law, according to the investigating officer or the superior officer monitoring the investigation, necessary steps be taken for invoking harsher process of law for tracing out the co-accused persons.

Liberty is granted to the petitioner to ventilate the grievance of the petitioner by way of communicating to the Deputy Commissioner of Police who would assess as to whether there is any flaw till date in respect of the proceedings with the investigation of the case.

With the aforesaid observations, the writ petition being WPA 4369 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
