(Via Video Conference) Mr. Biswajit Hazra ... for the petitioner Mr. Santanu Kumar Patra Mr. Rajib Kumar Basak ... for the University of Calcutta The petitioner is a student of four year Bachelor of Technical Course conducted by the University of Calcutta. He appeared in the 2nd semester examination in 2017 and failed to obtain qualifying marks in the subject Sociology. He failed to avail the opportunity for appearing in the supplementary examination in the years 2018 and 2019. He appeared in the 2nd semester special supplementary examination 2019 held in November 2019 and again failed to obtain the qualifying marks. The University disqualified the petitioner for further appearing in the said examination. The petitioner is aggrieved by the same. He has made a prayer for before the University with a request to permit him to appear in the resupplementary examination in the 4th year.

The representation of the petitioner dated 25.01.2021 has not been answered by the respondent University till date. The learned advocate representing the University of Calcutta submits that the petitioner has failed to avail the opportunities to clear the said examination and accordingly he has been held to be disqualified to appear

in the examination any further.

As it appears that the representation of the petitioner is pending consideration at the end of the respondent University, accordingly, the writ petition is disposed of by directing the Controller of Examinations (acting), University of Calcutta to take a decision with regard to the prayer of the petitioner made on 25.01.2021 permitting him to appear in the re-supplementary examination at the earliest, but positively within a period of three weeks from the date of communication of a copy of the order. The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

The petitioner is directed to forward a copy of the representation dated 25.01.2021 to the aforesaid respondent at the time of communicating the order of the Court.

W.P.A. 4986 of 2021 is disposed of.
