The petitioner has prayed for a direction upon the respondent Howrah Municipal Corporation to demolish the illegal construction raised by the private respondents.

It appears from the report that has been filed by the Howrah Municipal Corporation in Court today that the Howrah Municipal Corporation has already demolished the unauthorised portion of the building as far as practicable. The report mentions that it is not possible for the Corporation to demolish any further structure, as the entire building may collapse. The Howrah Municipal Corporation being an expert body has come to a finding that any further demolition may cause the entire building to collapse.

As the Corporation has already been taken steps for demolishing the unauthorised construction as far

as possible and practicable, no further order can be passed in the present writ petition.

The writ petition stands disposed of.
