As the process was initially issued by way of summons, learned Magistrate will release the petitioner on bail but on such terms and conditions that his appearance is ensured before the court on the subsequent dates. The complainant thereafter will adduce his evidence before charge and the petitioner is granted liberty to approach this court at the appropriate stage of the case preferably at the stage of Section 245 of the Code of Criminal Procedure.

With the aforesaid observations, CRR 648 of 2023 is disposed of.
