AGP Ms. Reshma Chatterjee ...for the State The petitioners claim to be the owner of RS and LR plot nos.105 and 195, within Mouza Dasagram Nankar, under Sabang Police Station, in the District of Paschim Medinipur. The petitioners allege that the respondent authorities are taking steps to utilize the aforesaid plots of the petitioner for the purpose of construction of a road. The petitioner submitted a representation before various authorities including the Block Development Officer, Sabang Block dated 4th February, 2026 requesting the authorities not to construct road upon the property of the petitioners. The learned Advocate for the petitioners submits that the property of the petitioners could not have been utilized without taking steps for requisition or acquisition of the plots in question.

Mr. De, learned Additional Government Pleader submits that the Block Development Officer, Sabang Block, being the third respondent, is the appropriate authority who can take a decision with regard to the issues ventilated by the petitioners in the said representation.

The learned advocate for the petitioners submits that the men and agents of the West Bengal State Rural Development Agency are taking steps to construct the road in question.

In the light of the submissions made by the learned Advocates for the respective parties, WPA 4500 of 2026, stands disposed of by directing the Block Development Officer, Sabang, being the third respondent, to consider the representation of the petitioners dated 4th February,2026 and to dispose of the same by passing a reasoned order as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of the order along with a copy of the representation dated 4th February, 2026 and after affording an opportunity of hearing to the petitioner or their authorized representative. The reasoned order shall be communicated to the petitioners within the time limit as fixed hereinbefore.

It will be open for the Block Development Officer, to call upon the authorities of the West Bengal State Rural Development Agency, being the fourth and fifth respondents, to produce any documents etc. that may be necessary for the purpose of arriving at a decision in terms of this order. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
