This revisional application was preferred challenging the order dated January 21, 2020 passed by the learned Judicial Magistrate, 5th Court, Barrackpore in M. Case No.701 of 2011.
On an appreciation of the materials, learned Magistrate was pleased to award interim maintenance of Rs.3,000/- per month to the wife/opposite party. Having regard to the fact that the order of interim maintenance was passed for survival of the wife/opposite party during pendency of the main application under Section 125 of the Code of Criminal Procedure, I am of the view that there was no error committed by the learned Magistrate in passing such order. Having regard to the present cost index, the quantum of interim maintenance so awarded also do not require any interference.
Accordingly, CRR 652 of 2020 is dismissed.
Interim order, if any, is hereby vacated.
All pending connected applications, if any, are consequently disposed of.
