The immediate ground of urgency alleged by the petitioners is the date of fixing of the sale of the immovable property-in-question today i.e. 24th February, 2023.

Learned counsel appearing for the respondent Bank submits that the sale has become infructuous due to lack of adequate number of bidders. The petitioners are already before the statutory forum, namely, the Debts Recovery Tribunal-I, Kolkata, by filing an application challenging the 'Possession Notice'. Petitioners apprehend that the Bank may take steps to frustrate the application by acting in terms of the 'Possession Notice'.

Since the sale has been rendered infructuous, nothing further remains to be decided in the writ petition.

W.P.A.4363 of 2023 is accordingly disposed of in terms of the above.

Since this court has not gone into the merits of the case, all points are kept open to be agitated before the Debts Recovery Tribunal.
