It is categorically submitted on behalf of the WBSEDCL that the impugned pole is a Mini High Mast Steel Tubular Street Light Pole which has not been installed by WBSEDCL but by the Corporation.

In such circumstances, the grievance of the petitioner insofar as it is directed against the WBSEDCL is misconceived.

On behalf of private respondent, it is submitted that the land on which the subject pole has been installed does not belong to the petitioner.

In view of the above, WPA 4597 of 2026 is dismissed as misconceived and not maintainable. Liberty is granted to the petitioner to file a fresh writ petition against the concerned Municipality and adjudicate their grievance in accordance with law.
