The Head Mistress of Kalikakhali Saradeswari Balika Vidyapith filed an affidavit-in-opposition, as directed by a Co-ordinate Bench on 06.05.2022, is taken on record. Copy of the same has been served. The Head Mistress also tenders an unconditional apology for the little delay in transmitting the service of records of the petitioner from the old school to new school.

In the above circumstances, the apology of the Head Mistress, namely, Smt. Susmita Santra Maity of Kalikakhali Saradeswari Balika Vidyapith is accepted with the warning not to repeat such conduct in future. Any delay in transmitting the records of a transfer teacher to the new school causes serious jeopardy to the future of the teacher.

In those circumstances, the order restraining payment of salary to the said Head Mistress shall stand vacated. The Head Mistress shall continue to receive salary. Arrear salary of the petitioner from October 2021 till May 2022 shall be paid by the new school, namely, Khajra Satish Chandra Memorial High School/respondent no. 10 within one month from the date of communication of a copy of this order. The petitioner shall make an application, if not already done, for transfer of PF account to the new school upon complying with all formalities. Such application of transfer shall be effected within a period of one week thereafter.

The writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
