This matter has been listed today upon the same being mentioned on August 20, 2025 by Mr. Debasish Mitra, learned Advocate representing the petitioner. It was submitted that the matter needs to be withdrawn and as such the same should be taken up out of turn. A notice of mentioning dated August 19, 2025 alongwith a printout of email has been produced in order to demonstrate service of notice of mentioning upon the learned Advocate appearing for the respondent no. 2. The mentioning slip accompanied by the notice of mentioning along with a print out of the email is taken on record.

Mr. Mitra, assisted by Mr. Sumit Mishra, learned Advocate on record for the writ petitioner, submits that since Coal India Limited has already invoked the arbitration clause in the relevant agreement and an Arbitrator has been

appointed pursuant thereto, the writ petitioner seeks to withdraw the present writ petition in order to avail of appropriate remedies.

In view of the aforesaid submissions made on behalf of the writ petitioner WPA 4455 of 2025 is dismissed as withdrawn.

There shall be no order as to costs.
