Dipali Sen @ Dipali Saha Sen v. State Of West Bengal
C.R.R.719 of 2024 D/L80 01.03.2024 Bpg.
In Re: An application under Section 482 of the Code of Criminal Procedure, 1973;
Dipali Sen @ Dipali Saha (Sen)
Versus
The State of West Bengal Mr. Sumanta Charkraborty.
...for the petitioner.
Mr. Bibaswan Bhattacharya.
...for the State.
The present revisional application has been preferred for expediting the trial of G.R. Case No.2204 of 2020 arising out of Barasat Police Station Case No.405 of 2020 dated 01.09.2020. Mr. Bhattacharya, learned advocate appearing for the State has submitted a report. Let the report be kept with the record. Report reflects that date has been fixed for consideration of charges on 16.08.2024.
Having regard to the prayer so advanced on behalf of the petitioner to expedite the progress of the trial, I direct the learned trial court to overcome the stage of consideration of charges on the next date so fixed and fix at least one date for the purposes of the trial of the case in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties and if any witness is present, the learned trial court would ensure that the witness do not return without being examined. Learned public prosecutor conducting the case would produce all the materials,
documents and exhibits on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the trial court to conclude the trial at the earliest.
With the aforesaid observations, CRR 719 of 2024 is disposed of.
Pending connected application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
