The petitioner by way of filing this public interest litigation alleges that on account of movement of heavy vehicles carrying sand, which has been mined by the private respondent, the underground pipeline is being damaged. Therefore, the petitioner seeks for appropriate direction.

Since affidavits are not called for, the allegations made by the petitioner are not gone into. However, considering the fact that if there is any damage to the pipeline, which is supplying water to the villagers, it is a matter of concern. Therefore, we direct the respondent no.7, namely, the Executive Engineer, Public Health Engineering (Phe) Department, Bankura Division to conduct an inspection of the place in question and assess the situation and if

there is any likelihood of damage to the pipeline adequate steps may be taken for preventing the same and if there is any damage already done appropriate repairing work shall be carried out. This direction shall be complied with within a period of three weeks from the date of receipt of the server copy of this order.

With the above direction, this writ petition is disposed of.
