The petitioner was appointed in the post of Peon in J.H.R. Senior Madrasah (Fazil) at Jalalpur, District : Malda on compassionate ground.

The petitioner by the instant writ petition is praying that he may be appointed in the post of an Assistant Teacher in the primary section in modification of the recommendation of his appointment bearing Memo No.

MSC/DIH/Reco/172/2020 dated February 20, 2020.

The prayer of the petitioner for more compassion cannot be entertained particularly in view of the judgment of the Hon'ble Supreme Court in the case of STATE OF RAJASTHAN -

VERSUS- UMRAO SINGH reported in (1994) 6 SCC 560.

The writ petition being WPA 5031 of 2021 is dismissed. No order as to costs.
